About Rosanne

Rosanne Yang guides clients with a practical eye to achieving company objectives while complying with increasingly complex laws and regulations.  Rosie leverages her experience across privacy, IP, and advertising to bring a comprehensive view to issues, such as the broad cross section of legal topics involved in the use of artificial intelligence and machine learning.

Rosie has extensive experience developing and executing intellectual property strategies for clients with clearing, registering, licensing, and enforcing rights domestically and internationally. Her work includes ensuring appropriate contractual controls and internal policies regarding the use of AI in developing IP assets, rights of publicity clearance, product design clearance, and product design collaboration agreements.

She advises on a range of marketing and advertising matters, including third party marketplace operations; promotional advertising; substantiation of claims consistent with FTC, FDA, CPSC, and other regulatory frameworks; and influencer advertising. She prepares website terms of use and privacy policies; counsels on internal corporate policies on a variety of topics, including the use of AI by employees and vendors; and creates internal training materials.

Responsive to the flood of states implementing new or updated consumer privacy frameworks, Rosie devised a business-friendly blueprint for clients to use in identifying key issues and working through implementation details to leverage existing compliance and streamline new efforts.

With over a decade of in-house experience, Rosie understands the importance of her clients’ operational procedures and challenges, as well as their risk tolerances, and works closely with various members of clients’ teams to facilitate practical problem solving. She represents clients across a wide array of industries, including retail and consumer goods, education, and cryptocurrency.  She also practices what she preaches: following her own advice regarding the vetting and selection of third party AI tools, Rosie selected an AI-based trademark clearance tool which is bringing increased value to the firm’s clients. She is a member of the International Association of Privacy Professionals (“IAPP”) and is certified CIPP/US and is a certified Artificial Intelligence Governance Professional (AIGP).

REPRESENTATIVE Experience

  • Counseling on policies covering responsible use of generative artificial intelligence (AI) and other machine learning technologies.

  • Designing and implementing privacy compliance programs, including for California’s enhanced regulation (CPRA), and similar regulatory frameworks in Virginia, Colorado, Connecticut, and Utah

  • Day-to-day counseling on the domestic and international collection, use, storage, and sharing of data

  • Strategic development and management of international trademark and copyright portfolios, including clearance, registration, licensing, and enforcement of trademarks, domain names, and copyrights

  • Advising on advertising claims substantiation, including pricing, environmental, and social responsibility claims, as well as the compliance programs behind them

  • Counseling on broad array of advertising initiatives, including entertainment content, contests and sweepstakes, loyalty programs, social media engagement, text messaging, and app development

  • Experienced with drafting and negotiating technology, IP, and marketing contracts, including influencer agreements.

  • Drafting and negotiating product sourcing, and product supply agreements

  • Drafting website terms of use and privacy policies.

  • Preparing internal training materials on topics such as intellectual property, advertising, and privacy.

  • Supporting merger and acquisition events with respect to due diligence and contract clauses on intellectual property, advertising, and privacy

  • Drafting technology and information governance policies including acceptable use, information security, records management, and supply chain compliance policies

  • Crisis management and advising on public and governmental relations communications relating to crises

  • Former VP and Chief Counsel, Intellectual Property and Regulatory, for a $5B national retail conglomerate, with extensive experience in both marketing and privacy issues
