OpenAI sued again; ILG becomes Foundational Supporter of the IAPP AI Governance Center; Read our AI blog series
Toward the end of September, OpenAI was sued by John Grisham, George RR Martin and other authors claiming “flagrant and harmful infringements of [their] registered copyrights”. The authors claim that OpenAI violated the Copyright Act by reproducing, without consent, the authors’ copyrighted works for purposes of training their large language models (LLMs), including ChatGPT. Additionally, they claim that the LLMs create outputs that are derivative of the authors’ copyrighted work. The authors seek to enjoin OpenAI from using the copyrighted works in training their LLMs without express authorization, as well as damages, including OpenAI’s profits attributable to the infringement. This, however, is not the first time OpenAI’s use of information to train its LLMs has been challenged in court. OpenAI currently faces a number of these lawsuits. For instance, in the last few months, two San Francisco authors brought a class action against OpenAI for using their copyrighted works to train ChatGPT, and comedian Sarah Silverman sued OpenAI for using her memoir for LLM training. More challenges to the training practices of OpenAI and other AI developers are likely to come.
