Apple’s New Privacy Requirements: What Attorneys Must Know When Providing Guidance to Clients

Apple has announced upcoming privacy and security updates and requirements including (1) standardized disclosure of privacy practices (Apple Store “Nutrition Label”), and (2) changing from opt-out to opt-in consent for device tracking (i.e., opt-in default for IDFA). We will discuss the key privacy issues to identify when providing guidance to your clients on how to prepare their businesses for the upcoming changes in Apple’s privacy requirements. You will need to ensure that your clients are making true and accurate disclosures, and that the disclosures they make will not trigger unknown privacy obligations or potential liability. Further, you will want to address any business or contractual issues resulting from the changes to opt-in consent for IDFA (or similar tracking mechanisms) and confirm that the methods for obtaining consent meet applicable privacy law and Apple-specific requirements. You want to be sure your clients are consulting with the legal department, privacy office or you as in-house/outside counsel before making any privacy disclosures or changing consent disclosures and mechanisms.
